  • |Militzok & Associates files class action lawsuit against Monroe County dermatologist for using non-FDA approved cosmetic injectables

    MONROE COUNTY, FLORIDA – [March 9, 2023] – Militzok & Associates, P.A., a leading law firm practicing in consumer protection cases, has filed a class action lawsuit against a Monroe County dermatologist for allegedly using non-FDA approved cosmetic injectables on patients without their knowledge or consent.

    The lawsuit, filed March 8, 2023 in Monroe County Circuit Court against Doctor’s Spa at Duval Square, Inc. and Dr. Adrienne Curran, M.D., under case number 23-CA-000148-K, seeks damages on behalf of all patients who received the injections between March 9, 2019, and September 15, 2022. The lawsuit claims that the dermatologist substituted non-FDA approved cosmetic injectables, which were not approved for use in the United States, into patients without their knowledge or consent.

    According to Brian Militzok, lead attorney for the plaintiffs, the dermatologist’s alleged conduct was unethical and violated the standard of care owed to patients. “Our clients trusted this dermatologist to provide safe and effective treatments. Instead, they were injected with non-FDA approved substances at inflated prices and which could have caused lasting harm. We intend to hold this dermatologist accountable for her actions.”

    The lawsuit claims that the dermatologist failed to inform patients that they were receiving non-FDA approved injectables in place of name brand injectables the patients believed they were paying for including: Botox, Juvederm Ultra, Juvederm Volume, Restylane with lidocaine, Restylane Define, Belotero with lidocaine and/or Sculptra and failed to obtain their informed consent of the substitution.

    The class action seeks damages for the cost of the treatment paid by the patients for these treatments. The law firm is calling on other patients who received injections from the dermatologist during the specified time period to come forward and join the class action.

  • |Attorney Matthew Militzok Wins Head of Household Garnishment Exemption Decision

    In a recently published decision in Florida Law Weekly Supplement, Attorney Matthew J. Militzok successfully argued that a wage earner who provided more than one-half of the financial support of a parent and who otherwise had no other dependents (such as children), qualified for the head of household exemption under Chapter 222 of the Florida Statutes. The Debtor had incurred an unpaid credit card debt. The credit card company obtained a judgment and obtained a wage garnishment against the Debtor. The Debtor argued that she supported her parents who lived with her and as a result provided more than one-half of their financial support. The Judge ruled that although Florida case law had not previously recognized that parents could be specifically defined as “dependents”, she found that parents do qualify as dependents in the same way that dependent children do under the statute. Previously, case law found that dependents primarily included minor children and adult children who had a disability and were otherwise unable to support themselves.
